Luby's Responds

About what I expected.

I updated today's GRE.

Let's see if sending them the link elicits something beyond corporate weaselspeak.

It wouldn't hurt if some of you independently let them know you expect an answer if they expect your patronage.

A Legal Bleg

Received the following from a regular reader. He's asking me questions way above my pay grade, so I'm soliciting informed opinions.
My father-in-law is a Norwegian Citizen, as is of course my wife. He kindly offered to me as a gift a Sauer & Sohn 7.65

http://www.handgunsmag.com/featured_handguns/sauer38_082306/

I have found that according to the ATF, it carries 69 points and needs 75. I assume this is part of the "Sporting" use nonsense.

Would love to publicize this whole harangue--I am in Kuwait--a Florida National Guard soldier here...my wife in Norway can legally own the thing, but in the US, I can't. We might not be able to press delete all at once on the GCA, but can't we whittle away at the "Sporting" use section. The 2A is hardly about sports and neither is it some traditional home defense remedy. What is Alito trying to sell that "due Process" pablum? Thomas is the only one who got it right.

Anyway, I wouldn't mind any suggestions. Also, if you suggest a lawyer willing to look into it--assuming you think it's something a lawyer would want to look at (would I be denied standing?---do you have to go to jail to get standing?) If I had standing and a lawyer, any ideas how to fund that little excursion--I doubt the NRA will be interested in the "Sporting" use clause of the GCA--I get the impression, Sports is what the NRA thinks 2A is about!

Your thoughts are welcome...I don't have a charity backing me up if you say "go for it"
Addendum:
Some extra details. I have a CR FFL---they told me that was not a good enough FFL even had it had the 75 points--and the item is > 50 years old--but the main issue is challenging the Sporting Rule. Here is the worse item...My Father-in-law's papers indicate it is defective, so it likely can't ever shoot---but I can't be sure. I am in Kuwait with my unit and have not seen the weapon in person.
Thoughts? Discussion?

A Question of Authority

"The state seeks to have illegal orders of expungement set aside .... The judge who signed the expungement orders was without the legal authority to do so." [More]
Government usurping authority?

Unbelievable!

Funny though--I assume the complaining DA took an oath to uphold the Constitution--I don't see him squawking over how "gun permits" square with "shall not be infringed"...

But then again, I have a pretty peculiar take on people who shouldn't have guns.

Yeah, it's the stores' fault.

Pretty neat "Only One" verdict, though.

If Grant had popped a prone Mehserle in the back, what do you think the chances are he'd have gotten off with involuntary manslaughter?

We all realize that if the rioting gets worse and the cops end up killing more, we could well see other cities react...?

We're the Only Ones Back to School Enough

U. S. District Court Judge Mark Bennett ordered Osceola County, Iowa Sheriff Douglas Weber to issue a concealed carry permit to Paul Dorr because the court found that Sheriff Weber had infringed Mr. Dorr's First Amendment rights. Judge Bennett did not stop there. He ordered Sheriff Weber to take a college-level course involving the First Amendment. [More]

Dumber Than Dirt

A satisfied Rapex customer has started a Facebook site to protest the opening of a Cheaper Than Dirt outlet in McKinney, TX.

I got a kick out of this bit of hysteria:
The store is approximately 3,800 SQUARE FEET!!!! in size...
OH NO!!!! Why, just think how many of those you could fit inside, say, your average Cabela's!

I don't know who the moron behind this effort is, but if you're a Facebook member, you might want to wander over there and point and laugh.

Will Luby's end Fuddruckers' 'no guns' policy?

Based on the all-too-evident results, Luby's is utterly incapable of protecting its customers, nor should they be expected to. By the same token, if they expect gun owner patronage, we deserve to know their position on our ability to protect ourselves, and if we can expect to see any changes in Fuddruckers policy once they assume ownership and control. Today's Gun Rights Examiner column notes that corporate acquisitions also assume liabilities along with assets.

This Day in History: July 9

I was this afternoon favoured with your letter of the 8th. Inst. While you are at Elizabeth Town, I wish you to obtain the best intelligence you can from time to time of the Enemy’s situation and [inserted: of] any movements, they may seem to have in view. For this purpose you will employ the persons you mention, or such others as you may judge necessary. Whatever expenses you are at, upon this occasion, will be repaid on the earliest notice. [More]
